PlacePal Terms of Service

1. What PlacePal Is

PlacePal is a voice-first iOS app that helps you remember where you put things. You speak, PlacePal processes your voice on-device, understands your intent using AI, and stores or retrieves item locations for you.

PlacePal is a memory aid. It is not a medical device, safety system, or replacement for professional care. Do not rely on PlacePal for tracking medications, medical equipment, or anything where a failure to locate an item could result in harm.

2. Eligibility

You must be at least 13 years old to use PlacePal. By creating an account, you confirm that you are 13 or older.

3. Your Account

• You need a valid email address to create an account
• You are responsible for maintaining access to your email for authentication
• One account per person
• Don't share your account credentials or let others access your account
• You are responsible for all activity under your account

4. What You Can Do

With a PlacePal account, you can:

• Store items and their locations using voice or text
• Retrieve item locations by asking PlacePal
• Edit, delete, and export your stored items
• Customize your voice preference

5. Free and Premium Tiers

PlacePal offers a free tier and a premium tier. The free tier includes core voice storage and retrieval. Feature limits and pricing for the premium tier will be communicated within the App.

We reserve the right to modify tier features, limits, and pricing. If changes affect your current plan, we will notify you in advance.

6. Acceptable Use

Don't use PlacePal to:

• Store illegal content or content that violates others' rights
• Attempt to access other users' data
• Reverse-engineer, decompile, or extract source code from the App
• Circumvent rate limits, authentication, or security measures
• Use automated tools (bots, scrapers) to interact with the App
• Impersonate another person or misrepresent your identity

We may suspend or terminate accounts that violate these rules.

7. Your Data

• You own your data. Items, locations, and profile information you create belong to you.
• We need a license to operate. By using PlacePal, you grant us a limited license to store, process, and transmit your data solely to provide the service. This license ends when you delete your account.
• Deletion is real. When you delete an item, it's soft-deleted immediately (hidden from all queries) and permanently removed within 30 days. Account deletion removes everything.
• Export anytime. You can export your data in CSV, JSON, or PDF format.

8. AI Processing

PlacePal uses artificial intelligence (Anthropic's Claude) to understand your voice input and generate responses. AI processing means:

• Responses may be imperfect. Claude may occasionally misinterpret what you said, categorize an item incorrectly, or give an unexpected response. Always verify important information.
• No guaranteed accuracy. PlacePal stores what it understands from your voice input. If the transcription or intent parsing is incorrect, the stored information will reflect that.
• Continuous improvement. We work to improve accuracy, but AI systems have inherent limitations.

9. Service Availability

• PlacePal requires an internet connection for storing and retrieving items (voice processing happens on-device, but database operations require connectivity)
• We aim for high availability but don't guarantee uninterrupted service
• We may perform maintenance, deploy updates, or experience outages
• Rate limits apply (currently 50 requests/day on the free tier)
• We will make reasonable efforts to notify you of planned downtime

10. Intellectual Property

• The PlacePal name, logo, design, and code are our intellectual property
• Your use of the App doesn't transfer any ownership rights to you
• You may not use PlacePal's branding without written permission

11. Disclaimer of Warranties

PlacePal is provided "as is" and "as available." We make no warranties, express or implied, including but not limited to:

• Fitness for a particular purpose
• Accuracy or reliability of AI-generated responses
• Uninterrupted or error-free operation
• That stored data will never be lost (back up important information independently)

12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

• Indirect, incidental, special, or consequential damages
• Loss of data, profits, or use
• Damages arising from your reliance on PlacePal's AI responses
• Damages exceeding the amount you paid us in the 12 months before the claim (or $50, whichever is greater)

13. Termination

• By you: Delete your account at any time by emailing privacy@heyplacepal.com. All your data will be deleted within 30 days.
• By us: We may suspend or terminate your account if you violate these Terms, with notice when possible. In cases of serious violations (security threats, abuse), we may act immediately.

Upon termination, your license to use the App ends. Sections 7 (Your Data, deletion provisions), 11, 12, and 14 survive termination.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Oregon, United States. Any disputes will be resolved in the courts of the State of Oregon, unless we mutually agree to alternative dispute resolution.

15. Changes to These Terms

We may update these Terms. If we make material changes, we will notify you through the App or via email at least 30 days before they take effect. Continued use after changes take effect constitutes acceptance.
